Understanding Divorce

Grounds for Divorce

In Massachusetts, there are two types of divorce – no-fault and fault. No-fault divorces only require you to plead that the marriage is beyond repair and you wish to move on with your life. A fault divorces are designed to litigate who is at fault and determine who receives the greater share of the property and/or damages based on proof.

Divorce Timeline

There’s no concrete timeframe for divorce proceedings but the minimum time to finalize a divorce is 90 days due to the statutory waiting period. There are ways to ensure the process doesn’t drag on by coming to an amicable agreement with your spouse on subjects such as property division, child custody, and more. Your attorney can also assist with making the process as stress-free as possible during all stages of negotiation.

Cost of Divorce

The cost of your divorce ranges on the type of divorce, time spent negotiating or mediating, if you have children, and several other factors. You can expect to pay anywhere between $2,500 to $20,000 and possibly more based on your specific situation. It’s best to consult with an attorney to get a better understanding of how the process works and a rough estimate of your legal fees as well as court costs.

Finalizing Divorce

A divorce is final 90 days after a judge signs a Judgement of Divorce. At that time, you and your spouse are officially and legally divorced. If you wish to modify the terms of your divorce after this time, both parties agree to the changes and submit a signed modification to the court for a judge to finalize. If only one party can agree, they’re required to file a Complaint for Modification to convince the court new facts or unknown facts were discovered that prove a material change of circumstances.
